Terms of Use

These Terms of Use (the “Terms”) govern your use of Graphite: the web and mobile application at app.graphite.trade (the “App”) and the website at graphite.trade (the “Site”), together the “Service”. Graphite is published by its developer, reachable at tradegraphite@gmail.com (“Graphite”, “we”, “us”).
By opening the App, connecting a wallet or linking a device, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. The App asks you to confirm your acceptance before you can trade, and asks again whenever these Terms change.
1. What Graphite is
Graphite is a software interface to the Hyperliquid decentralised exchange (“Hyperliquid”). It draws a chart, lets you place stop, target, entry and trigger levels on it, computes a position size from those levels and the risk you choose, and sends the resulting orders to Hyperliquid on your behalf.
- Non-custodial. Graphite never holds your funds and cannot move them. Deposits, withdrawals and transfers happen on Hyperliquid, outside the App.
- No account. There is no Graphite account, username or password. Your Hyperliquid account is identified by your wallet address.
- No backend. Graphite has no server that stores your data. The App runs in your browser or on your device and talks directly to Hyperliquid’s public API and to your wallet.
- An interface, not an exchange. Orders are matched, positions are held, funding is charged and liquidations are carried out by Hyperliquid under its own rules. Graphite has no discretion over any of it.
2. Who may use Graphite
You may use the Service only if all of the following are true:
- You are at least 18 years old, or the age of majority where you live if that is higher.
- You are not a US person, you are not located in the United States, and you are not located in, or a resident or national of, any country or territory subject to comprehensive sanctions, nor a person on any sanctions list.
- You are not excluded by Hyperliquid’s own terms of use, which apply to everything you do on Hyperliquid through Graphite.
- Trading cryptocurrency derivatives is legal where you are, and you are permitted to do it.
You are responsible for checking and complying with the laws that apply to you. Do not use a VPN, proxy or any other means to hide where you are in order to use the Service.
You may use Graphite only with a wallet you control. You are responsible for everything done through your wallet address, whether or not you authorised it.
3. Nothing here is advice
Graphite is a calculator and an order interface. It is not a broker, adviser, portfolio manager or fiduciary, and nothing in the Service is investment, financial, legal or tax advice.
- The position size, risk, reward-to-risk ratio (R), fees and every other figure the App shows are arithmetic on the levels and the risk you entered and on data provided by Hyperliquid. They are not a recommendation to buy, sell or hold anything, nor an opinion on where a price will go.
- Default levels — a stop placed at a multiple of recent range, a target at a multiple of the stop distance — are starting points for you to move, not suggestions.
- Figures for market and trigger orders are estimates. The fill you get depends on the order book at the moment of execution, and the realised risk can exceed the estimate. Fees are estimated from your current fee tier and may differ from what Hyperliquid charges.
- Order status, positions, prices and account balances shown in the App are read from Hyperliquid and may be delayed, incomplete or wrong. Hyperliquid’s own record is the one that counts.
You alone decide whether, what, when and how much to trade.
4. Fees
Graphite is free to install and use. Graphite earns a builder fee, a feature of the Hyperliquid protocol, on the trades you place through the App.
- What it is. A percentage of the notional value of each order that fills, charged by Hyperliquid at execution alongside its own trading fees and paid to Graphite’s builder address. It is not charged on orders that do not fill, on positions you close elsewhere, or on anything you do outside the App.
- How it is agreed. Before you can trade, the App shows the builder fee rate and asks you to approve a maximum rate with a signature from your wallet. Graphite can never charge more than the maximum you approved. The rate is also stated on the Site.
- Changes. If Graphite wants to charge more than you approved, the App will ask for a new approval; nothing changes until you give it. You can revoke the approval at any time on Hyperliquid, after which the App can no longer place orders for you.
- Shown in every figure. The builder fee is included in the fee estimate and in the net reward-to-risk ratio the App shows before you send an order, and in the results the journal reports.
- No refunds. The fee is collected by the Hyperliquid protocol at execution and is not refundable.
Hyperliquid charges its own trading, funding and other fees under its own terms. Your wallet provider and network may charge fees for signatures and transactions. None of these are Graphite’s.
5. Your wallet, your agent key and your devices
Agent wallet. To trade without a wallet prompt on every order, Graphite creates an agent wallet (an API wallet) and asks you to approve it on Hyperliquid with one signature from your wallet. The agent can place, modify and cancel orders on your account. It cannot withdraw or transfer funds. It expires after at most 180 days, and you can revoke it at any time on Hyperliquid.
Where the key lives. The agent’s private key is generated on your device and stored there, in the platform’s secure storage or the browser’s storage. It is never sent to Graphite, which has no server to send it to. If you clear your browser data, lose the device or uninstall the App, the key is gone and cannot be recovered by Graphite; you simply approve a new agent.
Device linking. The App can hand an agent key to another of your devices through a QR code sealed with a PIN. Anyone who obtains both the code and the PIN can trade on your account until the agent expires or is revoked. Show the code and share the PIN only with devices you control, and revoke the agent on Hyperliquid if you suspect either has been exposed.
Your responsibility. You are responsible for the security of your wallet, your seed phrase, your devices, your browser and its extensions, and any PIN or code the App gives you. Graphite cannot reverse an order placed with your agent key by someone who obtained it from your device.
6. Hyperliquid, wallets and other third parties
Graphite depends on services it does not control:
- Hyperliquid provides the market data, executes orders, holds positions and collateral, applies funding, margin and liquidation rules, and may change its API, its rules, its fees, its supported markets or its availability at any time, with or without notice. Graphite is not responsible for Hyperliquid’s downtime, latency, rate limits, data errors, rule changes, or for any loss arising from them.
- Your wallet (a browser extension or mobile wallet) signs the approvals Graphite asks for. Its security, availability and behaviour are its provider’s, not ours.
- Networks and hosting. The Service is served over the public internet through third-party infrastructure. Connectivity and availability are not guaranteed.
Your use of Hyperliquid is governed by Hyperliquid’s terms and privacy policy, which you accept separately. Where these Terms and Hyperliquid’s differ about what Hyperliquid does, Hyperliquid’s terms prevail.
7. Trading risk
Trading perpetual futures with leverage is highly risky. Before you trade, understand that:
- You can lose all of the collateral in your Hyperliquid account, quickly. Leverage magnifies losses as well as gains.
- A stop order does not guarantee an exit at its price. Stops are triggered at Hyperliquid’s mark price and filled as market orders; in a fast or thin market the fill can be far worse than the stop, and the loss larger than the risk you set.
- Market and trigger orders fill at whatever price is available. Slippage is not bounded.
- Positions can be liquidated by Hyperliquid, at a loss, with no action from you or from Graphite.
- Funding payments accrue while a position is open and can be material.
- Orders sent to Hyperliquid are final. They cannot be reversed by Graphite. An order you cancel may already have filled.
- The App may be unavailable, disconnected or showing stale data at the moment you need to act. Keep a way to manage your positions directly on Hyperliquid.
- Digital assets are volatile, and the rules that apply to them can change.
Trade only with money you can afford to lose.
8. Acceptable use
You agree not to:
- use the Service for anything unlawful, including market manipulation, wash trading, money laundering or sanctions evasion;
- circumvent, or attempt to circumvent, the eligibility restrictions in section 2;
- interfere with the Service, probe or attack it, or place an unreasonable load on it or on Hyperliquid through it;
- copy, modify, distribute, sell or reverse-engineer the Service, except as open-source licences on parts of it expressly permit;
- remove or alter any notice of ownership on the Service;
- use the Service in a way that damages Graphite’s reputation or its relationship with Hyperliquid.
9. Availability and changes to the Service
Graphite is provided as a work in progress. We may change, suspend or discontinue any part of the Service at any time, with or without notice, and we may release updates that change how the App works or looks. We do not promise that the Service will be available, uninterrupted, secure or error-free, or that any error will be fixed.
10. Intellectual property
The Service, including its code, design, name, logo, text and images, belongs to Graphite or its licensors and is protected by copyright, trade mark and other laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the App for its intended purpose, and nothing else. Parts of the Service may be published under open-source licences; those licences govern those parts.
11. No warranty
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, title or non-infringement. We do not warrant that the figures the App shows are correct, that orders will be sent or filled, that the Service will meet your needs, or that it will be free of harmful components.
12. Limitation of liability
To the fullest extent permitted by law:
- Graphite, its owners, developers, contributors and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, trading opportunity, data or goodwill, arising out of or in connection with the Service, however caused, even if advised of the possibility.
- Graphite is not liable for any trading loss, liquidation, missed fill, bad fill, order sent in error, or loss caused by Hyperliquid, your wallet, your device, your network, a third party, or your own act or omission.
- Graphite’s total liability for all claims arising out of or relating to the Service, in aggregate, is limited to the builder fees actually received by Graphite from your trades in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions; in those, the exclusions apply to the extent permitted.
13. Indemnity
You agree to indemnify and hold harmless Graphite, its owners, developers and contributors from any claim, loss, liability, damage or expense, including reasonable legal fees, arising from your use of the Service, your breach of these Terms, your violation of any law or of a third party’s rights, or your trading activity.
14. Termination
You can stop using the Service at any time: disconnect your wallet, forget the link on a linked device, and revoke the Graphite agent and builder fee approval on Hyperliquid. We may suspend or end your access to the Service at any time if we believe you have breached these Terms or if the law requires it. Sections 3, 4 (as to fees already charged), 6, 7 and 10 to 17 survive termination.
15. Changes to these Terms
We may change these Terms. When we do, the effective date at the top changes and the App asks you to accept the new Terms before you can trade again. The current Terms are always available in the App and at graphite.trade/terms. If you do not accept a change, stop using the Service.
16. Governing law and disputes
These Terms are governed by the laws of France, without regard to its conflict-of-laws rules, and any dispute arising out of or relating to these Terms or the Service will be brought in the courts of France. Before bringing a claim, write to the address in section 18 and give us thirty days to resolve it. Nothing in this section deprives you of any mandatory protection you have as a consumer under the law of the country where you live.
17. General
- If any part of these Terms is found unenforceable, the rest remains in effect.
- Our failure to enforce a right is not a waiver of it.
- You may not assign these Terms; we may assign them to a successor of the Service.
- These Terms and the Privacy Policy are the whole agreement between you and Graphite about the Service.
- These Terms are written in English. A translation, if one is provided, is for convenience only; the English text governs.
